1. Introduction
Welcome to SafiRide, Kenya's first locally-owned ride-hailing platform. These Terms and Conditions ("Terms") govern your use of our mobile application, website, and related services (collectively, the "Service") operated by SafiRide, a company incorporated in Kenya.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.
2. Service Description
SafiRide provides a technology platform that connects riders with independent drivers who provide transportation services. We are not a transportation company and do not own, operate, or control the vehicles used in connection with our Service.
- Ride-hailing services across Nairobi, Mombasa, Kisumu, and other major Kenyan cities
- Real-time GPS tracking and route optimization
- Secure payment processing through multiple payment methods
- 24/7 customer support in English and Swahili
- Driver and rider safety features and verification
3. User Accounts
To use our Service, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your contact information is always up to date
4. Payment Terms
Payment for rides is processed through our secure payment system. We accept:
- Mobile money (M-Pesa, Airtel Money, T-Kash)
- Credit and debit cards (Visa, Mastercard)
- Bank transfers
- Cash payments (where available)
All prices are displayed in Kenyan Shillings (KES) and include applicable taxes. We reserve the right to change our pricing at any time with reasonable notice.
5. Safety and Security
Your safety is our priority. We implement various safety measures including:
- Driver background checks and verification
- Vehicle inspection requirements
- Real-time GPS tracking during rides
- Emergency contact features
- 24/7 safety support team
Users are expected to treat drivers and other users with respect and follow all safety guidelines provided in the app.
6. Prohibited Uses
You may not use our Service for any unlawful purpose or to solicit others to perform unlawful acts. Prohibited activities include:
- Harassment, abuse, or threatening behavior
- Transportation of illegal substances or contraband
- Fraudulent payment activities
- Violation of any applicable laws or regulations
- Interference with the proper functioning of the Service
7. Limitation of Liability
To the maximum extent permitted by Kenyan law, SafiRide shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.
Our total liability to you for any claims arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
We comply with the Data Protection Act, 2019 of Kenya and implement appropriate security measures to protect your personal information.
9. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may terminate your account at any time by contacting our customer support team.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
